1. Acceptance of Terms: By booking our services or dropping off your items at Le Lavoir Limited ("the Company"), you acknowledge that you have read, understood, and accepted the terms and conditions outlined herein.
2. Responsibility for Items: The Company shall not be held responsible for any loss, damage, or theft of items left in our care. It is the sole responsibility of the customer to ensure that valuable or irreplaceable items are adequately insured prior to leaving them with us.
3. Inspection of Items: While the Company exercises utmost care in handling garments and items entrusted to us, we do not accept liability for pre-existing damage, wear and tear, or any defects not immediately apparent upon visual inspection.
4. Limited Liability: In no event shall the Company be liable for any direct, indirect, punitive, incidental, special, or consequential damages, including, but not limited to, loss of profits, revenue, data, or use, arising out of or in any way connected with the use or performance of our services.
5. Exclusion of Warranties: The Company makes no warranties, express or implied, regarding the suitability, reliability, availability, timeliness, or accuracy of our services. All services are provided on an "as is" and "as available" basis.
6. Indemnification: Customers agree to indemnify and hold harmless the Company, its officers, directors, employees, agents, and affiliates, from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of or related to the use of our services or any breach of these terms and conditions.
7. Force Majeure: The Company shall not be liable for any failure or delay in performing our obligations under these terms and conditions if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, or government actions.
8. Modification of Terms: The Company reserves the right to modify or amend these terms and conditions at any time without prior notice. Customers are encouraged to review the terms periodically for any changes.
9. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
10. Entire Agreement: These terms and conditions constitute the entire agreement between the customer and the Company, superseding any prior agreements or understandings, whether oral or written, relating to the subject matter herein.
